About the Course:

When it comes to enforcing intellectual property around the world, companies cannot solely rely on local intellectual property laws to enforce their rights. Infringers must be smoked out and shut down through a variety of creative strategies and tactics. In some cases, criminal laws must be applied–with the aim of imprisoning counterfeiters. This webinar presents a rare opportunity to learn how one of the world’s most successful IPR enforcers has contended with infringers in over 160 countries throughout a career spanning more than 20 years.

Fascinating stories are shared with respect to castrating counterfeiters from disparate parts of the world, such as China, Saudi Arabia and the Ukraine. This unique webinar sheds light on important questions in connection with contending with infringers. The following are among the issues discussed:

  • Why is it not always the best course of action to shut down counterfeiters at trade shows even if on-site judges are available to render such decisions?
  • What are the shortcomings of relying on legal measures (such as litigation, injunctions and settlements) to restrain counterfeiters?
  • What must companies do to thwart bribery?
  • What are the pros and cons of negotiating distribution rights with infringers?
  • What is the secret ingredient in making raids most effective?
  • Why might an outside counselor boasting about a large number of achieved take-down notices be a misleading signal about the capabilities of that lawyer in combatting counterfeiting activity?
  • What are some keys to coordinating with local officials?
  • How can a company vulnerable to pandemic counterfeiting send a message of its resolve to combat counterfeiting to the community of counterfeiters scattered around the world?
  • To what extent should legitimate manufacturers collaborate to defeat counterfeiters?
  • What can be done to discourage authorized distributions, manufacturers and licensees from going rogue (engaging in infringing activities)?
